General Terms and Conditions
Article 1 – Company Identity and Services
- Company details: REXLUDE is currently a sole proprietorship, with the intention to convert it into a Private Limited Company (B.V.) in the short term.
- Offering: REXLUDE specializes in the sale of sports apparel and sports accessories for men, women, and children. Our collection is designed for both intensive sports performance and daily comfort and leisure.
-
Target Audience: We supply both consumers (B2C) and businesses (B2B). REXLUDE aims to crown everyone as 'king of sports', regardless of background or physical ability. Our business focus also includes companies that sell clothing.
Article 2 – Financial Agreements and Payment
- Prices: All prices on the website include VAT and exclude shipping costs. Shipping costs are calculated during checkout, unless explicitly stated otherwise (e.g., for promotions above €100).
- Payment Term: Payment is made directly via the offered payment methods or afterwards within 14 days of the invoice date. "Payment must be made within 14 days of the invoice date, unless otherwise agreed via the chosen payment method."
- Default: In case of non-payment, we will send a mandatory, free reminder after 14 days. This will initiate a new 14-day period. This message will state the collection costs incurred if payment is not received.
-
Collection costs: In case of default, collection costs will be charged according to the statutory scale (with a minimum of €40 for invoices up to €250):
Principal up to and including Maximum € 2.500 € 375 € 5.000 € 625 € 10.000 € 875 € 200.000 € 2.775 Above € 200.000 € 6.775 Source: BKG-integraal Report 2013
- Transparency: To maintain a transparent relationship with our customers, REXLUDE does not include interest in the collection procedure. Our approach focuses on easily settling outstanding invoices without unexpected cost increases.
Article 3 – Delivery and Warranty
- Delivery Time: We collaborate with reputable postal companies to deliver products carefully and undamaged. Indicatively, delivery for the Netherlands is 1-2 working days and for Europe/UK 2-6 days. The maximum statutory delivery period is 30 days.
- Warranty Period: Defects must be reported within one month of purchase via dispute@rexlude.com. We aim to respond within 14 days.
- Warranty Exclusion: Warranty is void in cases of normal wear and tear (such as pilling), damage caused by contact with sharp sports equipment (such as zippers), or failure to strictly follow the washing instructions on the labels.
- Burden of Proof: In disputes, REXLUDE may request proof (photo/video) or have the product inspected by our quality staff at the customer's expense.
Article 4 – Right of Withdrawal and Returns
- Cooling-off Period: Consumers have a 14-day cooling-off period after receipt to cancel the purchase without stating a reason. The cost of return shipping is borne by the customer.
- Condition of the product: Trying on is permitted. However, if the clothing has been worn (e.g., during exercise), contains stains, or smells of perfume or sweat, a fee will be charged for the diminished value.
-
Hygiene Exclusion: For health protection and hygiene reasons, the following items are excluded from returns:
- Underwear (men's and women's) and sports bras.
- Water bottles, socks, headbands, and protective undergarments whose seal or packaging has been broken after delivery.
- Consequences: If these products are returned with a broken seal, the return will be rejected, and no refund will be issued.
Article 5 – Liability and Law
- Limitation: REXLUDE's liability is at all times limited to a maximum of the invoice amount of the respective order. We are only liable for direct damage; indirect damage or lost profit is excluded.
- Safe use: The use of sports accessories is at the customer's own risk. REXLUDE is not liable for personal injury due to improper use.
- Force Majeure: In case of force majeure (including strikes at delivery services, fire, or internet outages), obligations will be suspended. If the force majeure lasts longer than 30 days, both parties may dissolve the agreement with a full refund.
- Applicable Law: All agreements are exclusively governed by Dutch law. The court in REXLUDE's place of business has jurisdiction, unless the law mandatorily prescribes otherwise.
- ODR Platform: Consumers within the EU can also submit disputes via the Online Dispute Resolution platform.
